deviantART Summit Never Before Seen Footage

I am quite disappointed that the administration opted to censor my film based on the fact that it contained "copyrighted music," and offered no further clarification other than to point me to the FAQ entry that lists some URL's to online spots for music that is considered acceptable. What makes no sense about the explanation is that all published music is copyrighted. The following is the entire note that I received from the site administration:

"I had to remove your videos from the gallery this morning as they both contain copyrighted music and we can't allow that on the site. I really enjoyed both of them and would welcome you to repost them without sound or using a source we've listed in FAQ #852"


Notice the clearly worded "they both contain copyrighted music" statement that offers no clarification other than to say that copyrighted music is not allowed on the site? This makes absolutely no sense to me as, like I said, all published music is copyrighted.

Music from bands that are signed with the big labels, indie bands, bands that publish solely online, and whatever else, is all copyrighted. The only difference between these groups is that some are backed by the monolithic recording industry whereas the others are small bands with little, to no, money in their pockets. Regardless, they are all afforded the protections that copyright law offers, especially if they took the time to physically register their copyrights on paper and file with the copyright office.

I am not writing this out of some perverse desire to start any upheaval. Sometimes, writing about a situation is healing, and helps me better comprehend the situation itself. In this case, I am truly confused about this situation because the offered explanation makes absolutely no sense.

But I digress. I do not care any longer.

I have not posted here in over a year so it probably does not matter, but this is more than likely the straw that broke the proverbial camel's back. I will most certainly not post here again, which is sad if you really take a step back and think about it.

So anyhow, enough of that crap; just had to get that off my chest before I post the link to where the video is now located. I seriously hope that everyone does get a chance to check the deviantART Summit video out. Like I said before, the summit was a lot of fun, and finally turning the video in to a digital creation was a lot of fun as well.

I'm surprised you went to YouTube for resubmission. After finding Veoh, I decided to never post to YouTube again. They have higher-quality streaming, and an option to download the full-size version. Pus, they don't have the time-limit for submitted content. Okay, so I'm a Veoh-whore... >.< But I like watching Bleach in one sitting without having to click 3 different links on YouTube.

And yes. The high point was Lolly's crazy comment. ^.^ I think it was done well. Professional-looking.

The way fair use is shaking down in the legal world these days is, you use anything longer than a 5-10 second snippet of a song, you need to have paid for or otherwise obtained rights to use it.
It's pretty out of control. There's even instances of rappers and techno artists suing popular nite clubs for spinning their albums without paying royalties. I mean, wtf is a club for but to play the music that people want to hear? But they are saying now that the club is only popular due to the music played at it so they all seemed to have simultaneously watched Goodfellas and are pulling a Henry "Fuck you pay me!" Hill on them.

But the stance the labels and the artists themselves are taking is that if you take their music and put it to something of your own creation you are using them unfairly to promote your own creation and they want a piece of it.

Basically, pirating music got way the hell too out of control for a long time and now everyones paying for it since these companies have lost substantial money to it as record sales plummet more and more every year.

It sucks though as I dug that video and would liked to have seen it stay but we've already pulled a bunch for lesser infractions. This is our biggest hurdle and phase two of what we will be addressing and coming up with solutions for film wise.

There is content published that is royalty free, and free for use elsewhere. Kind of like stock music in that the creators have given permission for people to use. The music you had, it would appear was not royalty free nor free use music.

I personally find it saddening that you of all people are protesting against the removal of an illegal thing from the site you helped create. I'm not going to uphold any pretences here, I respect your work, but on an issue such as this, I side with the law.

Sorry Scott, but I really can't sympathise much here. The only thing I would say is find someone who does offer royalty free music for future use. I know that a lot of small name artists these days will offer their music under a creative commons license, which does allow use of their materials.

Understood. Sure with that the note I received offered such a sane, and descriptive, explanation of the infraction. Surely you can see how "copyright music is not allowed here" can be quite confusing. :-)

There are those however, who do offer their music for use by others under Creative Commons Licensing and the like. I would imagine these are allowed if the rules of the license are followed.
